1.The SCOTIAHOCKEY MOMENTS contest (the "Contest") commences at 12:00:00 p.m. ET March 4, 2009 and ends at 11:59:59 a.m. ET April 22, 2009 (the "Contest Period").
2. No purchase necessary. To enter, visit the website located at scotiahockey.tsn.ca, click on a Contest page, and complete and submit an entry by following the instructions found on the site.
3. To enter for a chance to win the Grand Prize, follow the instructions in paragraph 2 above and choose the "Live It" contest link. You can enter a total of five (5) times per Week. A "Week" is defined as the time period between 12:00:00 p.m. ET on Wednesday to 11:59:59 a.m. ET on the following Wednesday during the Contest Period. There is a limit of fifteen (15) entries per individual per Week for the Grand Prize draw based on a limit of five (5) entries made by choosing "Grand Prize" and entering in accordance with this paragraph, five (5) entries earned under paragraph 4 (Secondary Prize entry) and five (5) entries earned under paragraph 5 (Weekly Prize entry).
4. To enter for a chance to win one of the Secondary Prizes, go to scotiahockey.tsn.ca, fill out the appropriate text fields, and describe your favourite personal hockey moment by submitting one of the following: (1) a photograph, or (2) video upload; along with a maximum 200 word essay depicting your favourite personal hockey moment story in accordance with the submission guidelines in paragraph 10 (a "Submission"). There is a limit of one (1) entry per individual per Week under this paragraph. Each entry will automatically earn the entrant five (5) entries towards the Grand Prize and one (1) entry towards the Secondary Prize for the Week in which the Submission was entered.
5. To enter for a chance to win one of the Weekly Prizes, go to scotiahockey.tsn.ca and submit a maximum 100 word paragraph in English describing your opinion on the topic set out on that page (a "Submission"), in accordance with the guidelines below. The topic will be hockey-related and will be updated every Wednesday at noon starting on Wednesday, March 4, 2009. There is a limit of one (1) entry per individual per Week under this paragraph. Each entry will earn the entrant five (5) entries towards the Grand Prize and one (1) entry towards the Weekly Prize for the Week in which the Submission was entered.
6. There is a limit of one prize of any kind per entrant.
7. The contest sponsors are The Sports Network Inc. ("TSN") and The Bank of Nova Scotia (collectively, the "Contest Sponsors").
8. To enter and to be eligible to win, an entrant must be a legal resident of Canada (excluding Quebec) and be sixteen (16) years of age or older as of the beginning of the Contest Period. The following persons are not eligible to enter: (a) Employees of (i) The National Hockey League, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC, the NHL member clubs and each of their affiliates (collectively, the "NHL Entities"), (ii) the Contest Sponsors, and (iii) the agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators of the NHL Entities and Contest Sponsors (all of the above employees hereinafter referred to as "Employees"); (b) the parents, siblings and children of Employees; and (c) persons domiciled with Employees. Individuals who are under the age of majority at the date of entry are eligible to enter the Contest and win a prize provided that the parent or legal guardian of the entrant accepts the terms and conditions hereof for and on behalf of such entrant, and subsequently accepts any prize won for same. A winner of a TSN contest within the three (3) months preceding the start of this Contest (including persons designated by such winners to take ownership of prizes) and persons domiciled with such winners are not eligible to enter.
9. Entries received on-line shall be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries must include the entrant’s first and last name, address, email address, age, ten digit day time and evening telephone number.
10. Submissions in the form of videos must be in BMP/JPEG/MOV/WMV/MPEG file format and be a maximum of 10MB in file size Photographs must be in BMP/JPEG/GIF/TIFF file format and be a maximum size of 10MB in file size
11. Entries must include consent (the form and sufficiency of which shall be determined by the Contest Sponsors) of all identifiable persons in Submissions. Entries that involve persons who are unaware of their participation in a Submission or in cases where sufficient proof of consent by a participant is not provided to the Contest Sponsors as requested, will be disqualified.
12. Submissions should not include any business, designer, or sports logos, or persons bearing the name or likeness of a celebrity, living or dead. The Contest Sponsors reserve the right, in their sole discretion, to edit any Submission by, among other things, blurring out any trade-marks or removing any copyrighted content, including but not limited to, music or video clips.
13. Without limiting any of Contest Sponsors’ rights herein, entrants could be disqualified for providing: obscene, illegal, defamatory or unauthorized third parties’ proprietary content, anything potentially or actually dangerous or harmful or containing any element of physical risk.
14. By entering this Contest each entrant represents that (i) he/she has all rights necessary to enter the Submission into the Contest, including the right to have the Submission broadcast or displayed in any form of media; (ii) his/her submission does not infringe on any third party’s copyright, trade-mark or other intellectual property rights;
15. Each entrant agrees to release, discharge, indemnify and hold harmless the NHL Entities, the Contest Sponsors, their respective parent, subsidiary and affiliated companies, and their respective officers, directors, employees, agents and representatives, from any claim or liability arising from or related to participation in this Contest.
16. The copyrighted portions of Submissions remain the property of their respective owners, however by submitting an entry, each entrant grants the Contest Sponsors a license to reproduce, post and/or broadcast the Submission in any form of media, including, without limitation, on TSN.ca and ScotiaHockey.com. In the event the Contest Sponsors wish to exercise this license and the entrant is under the age of majority in his/her province/territory of residence, the Contest Sponsors will first obtain consent from the entrant’s parent or legal guardian in a form acceptable to the Contest Sponsors. Contest Sponsors assume no responsibility for any claims against an entrant for privacy or third party intellectual property rights violations with respect to any Submission entered.
17. Grand Prize - There is one (1) Grand Prize consisting of a trip for two (2) to the designated 2009 NHL®* Stanley Cup FINALS Game city and includes: two (2) tickets to an NHL Stanley Cup FINALS Game, round trip economy air fare for two (2) from a major Canadian airport closest to the Grand Prize winner's place of residence in Canada (hereinafter referred to as the "Departure Point"); two (2) nights accommodation (based on one (1) room, double occupancy), plus Five Hundred Dollars (CAD500.00) in spending money. The Grand Prize winner and his/her travelling companion are solely responsible for all costs not expressly described herein including, without limitation, applicable taxes, fuel/currency surcharges, ground transportation, meals, beverages, room service, gratuities, merchandise, telephone calls, insurance and all personal expenses of any kind or nature, together with any applicable overnight layover. Departure dates and hotel accommodation are subject to availability and may change without notice or compensation. The Grand Prize winner and his/her travelling companion are also solely responsible for all costs incurred to and from the Departure Point, as the Grand Prize originates and terminates there. It is the sole responsibility of each of the Grand Prize winner and his/her travelling companion to obtain all necessary travel documentation including passports and visas, as applicable and to comply with any customs and immigration requirements. The Grand Prize winner and his/her travelling companion must be able to travel at the times and dates as determined by the Contest Sponsors in their sole discretion and authority, failing which the Grand Prize will be forfeited. It is recommended that the Grand Prize winner and his/her travelling companion obtain sufficient personal insurance prior to departure. In the event the Grand Prize winner is under the age of majority, he or she must be accompanied by his or her parent or legal guardian at all times while participating in all components of the Grand Prize. All details of the Grand Prize including, without limitation, travel dates, locations, hotels, airlines and times, will be determined by the Contest Sponsors in their sole discretion. Approximate retail value of the Grand Prize is Five Thousand Dollars (CAD5,000.00) based on Vancouver departure to Tampa Bay, Florida.
18. Secondary Prize – There are seven (7) Secondary Prizes, each consisting of one (1) Scotiabank® NHL Prize Package that will include various NHL and/or Scotiabank branded merchandise with an approximate retail value of one hundred dollars (CAD100.00) and may include, for illustrative purposes only and in no way deemed to be a representative list, NHL merchandise consisting of a hat, bag, clock and/or watch, etc.
19. Weekly Prize – There are seven (7) Weekly Prizes, each consisting of one (1) Scotiabank NHL Prize Package that will include various NHL and/or Scotiabank branded merchandise with an approximate retail value of one hundred dollars (CAD100.00) and may include, for illustrative purposes only and in no way deemed to be a representative list, NHL merchandise consisting of a hat, bag, clock and/or watch, etc.
20. Prizes must be accepted as awarded. The Prizes are not transferable and may not be sold or transferred and are not convertible to cash except at the sole discretion of the Contest Sponsors. The Contest Sponsors reserve the right to substitute any prize, in whole or in part, with another prize of equal or greater value. Prize winner is solely responsible for all costs not expressly described herein. No change in travel arrangements can be made by the Grand Prize winner once the booking has been confirmed. The Grand Prize may not be used towards any type of frequent flyer mileage, or other reward point accumulation program.
21. Grand Prize - On or after Friday, April 24, 2009 at approximately 12:00:00 p.m. ET, a random draw for the Grand Prize will take place at the head office of CTV Inc. at Toronto, Ontario from among all eligible entries received during the Contest Period. The first entry drawn will be eligible to win the Grand Prize. The odds of winning the Grand Prize will depend upon the total number of eligible Grand Prize entries received during the Contest Period.
22. Secondary Prizes – Beginning Wednesday, March 11, 2009 and each subsequent Week during the Contest Period, at approximately 12:00:00 p.m. ET, a random draw for the Secondary Prize will take place at the head office of CTV Inc. at Toronto, Ontario from among all eligible entries for the Secondary Prize received during the previous Week. The first entry drawn will be eligible to win the Secondary Prize for the applicable Week. The odds of winning a Secondary Prize will depend upon the total number of eligible entries received for the Secondary Prize during the applicable Week.
23. Weekly Prizes – Beginning Wednesday, March 11, 2009 and each subsequent Wednesday during the Contest Period, at approximately 12:00:00 p.m. ET, a random draw for the Weekly Prize will take place at CTV Inc. at Toronto, Ontario from among all eligible entries for the Weekly Prize received during the previous Week. The first entry drawn will be eligible to win the Weekly Prize for the applicable Week. The odds of winning a Weekly Prize will depend upon the total number of eligible entries received for the Weekly Prize during the applicable Week.
24. TSN, using reasonable efforts, will attempt to contact each potential winner or, if under the age of majority, the potential winner’s parent or legal guardian, by telephone within two (2) business days after each draw. In the event the potential winner cannot be contacted within two (2) business days after the draw, he or she will be disqualified and an alternate potential winner will be drawn from among the entrants for the applicable Week, or in the case of the potential Grand Prize winner, from among all entrants received during the Contest Period. Proof of identification must be provided upon request. In order to be declared a winner, the potential winner must first correctly answer, unaided, without assistance of any kind, whether mechanical, electronic, or otherwise, a time limited mathematical skill testing question administered by TSN.
25. Before being awarded a prize, each potential winner or, if under the age of majority, the potential winner’s parent or legal guardian, and potential Grand Prize winner’s traveling companion, or, if under the age of majority, the traveling companion’s parent or legal guardian, will be required to sign and return within the time stipulated by the Contest a full release and indemnity as provided by the Contest Sponsors.
26. In the event that the potential winner and/or traveling companion, as applicable, do not comply with all the provisions of these Rules, the Contest Sponsors shall have the right to disqualify the potential winner and/or traveling companion, and draw an alternate potential winner and/or traveling companion and the Contest Sponsors shall be fully and completely released and discharged from any liability arising from this decision. These provisions and procedures relating to selection and notification of a potential winner and/or traveling companion, if applicable, shall be applied, with the necessary amendments, until a qualified winner and/or traveling companion have been duly selected.
27. By entering this Contest, each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsors for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsors will not sell or transmit this information to third parties except for the purposes of administering this Contest. Any inquiry concerning the personal information held by the Contest Sponsors should be addressed to TSN at contests@ctv.ca
28. By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsors with respect to any aspect of this Contest, including without limitation, the eligibility of entries or entrants, selection of winners and selection and execution of prizes, are final and binding on all entrants in all matters as they relate to this Contest, and are in the sole discretion of Contest Sponsors.
29. Illegible, altered, defaced, mutilated, or incomplete entries are ineligible. All entries, including Submissions, become the property of the Contest Sponsors and will not be acknowledged or returned. Contest Sponsors assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting these Rules by mail or requesting names of prize winners (for which a self-addressed, postage paid envelope must be included and sent to ScotiaHockey Moments Contest c/o CTV DMG, 299 Queen St, W, Toronto, ON M5V 2Z5). Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof in the offer or administration of this Contest, including but not limited to errors in advertising, the selection and announcement of winners, or the distribution of any prize. Entry materials or data that have been tampered with or altered are void.
30. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsors reserve their right to cancel, terminate, modify, amend, extend or suspend the Contest at any time without obligation or prior notice, including canceling any method of entry, and select a winner from previously received eligible entries. Contest Sponsors reserve their right to modify these Rules without materially affecting the terms and conditions hereof.
31. The Contest Sponsors reserve their right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable.
32. In the event of any discrepancy or inconsistency between these Rules and disclosures or other statements contained in any Contest related materials, the Rules shall prevail.
33. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsors and/or their affiliates, or NHL Entities as relevant. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
34. This Contest is subject to all applicable federal, provincial and municipal laws and regulations.
